Important Notice: SoftWave Therapy is a non-surgical, non-invasive acoustic wave treatment. It is not a substitute for medical diagnosis or emergency care. By receiving services, you agree to these Terms & Conditions and affirm that you have been provided an Informed Consent and Notice of Privacy Practices (HIPAA)

1) Scope of Services

1.1 SoftWave Therapy uses unfocused, electrohydraulic acoustic waves delivered via an FDA-cleared device to support tissue healing, pain modulation, and circulatory function. 1.2 Services may include assessment, treatment planning, treatment sessions, post-session guidance, and referrals. 1.3 Provider does not guarantee outcomes and does not provide primary medical care or diagnostics. You should consult a licensed physician for medical evaluation.

2) Eligibility & Contraindications

2.1 You confirm you are at least 18 years of age (or a legal guardian has consented for a minor). 2.2 You must disclose full and accurate medical history, including:

Pregnancy or suspected pregnancy
Active cancer
Bleeding disorders or current use of anticoagulants
Peripheral vascular disease, deep vein thrombosis (DVT) history
Neurological disorders affecting sensation in treatment area
Implants/devices (e.g., pacemakers) or metal hardware near treatment area
Open wounds, skin infections, or acute infections
Recent steroid injections in treatment area
Severe osteoporosis or acute fractures 2.3 Provider may decline or defer services if contraindicated or if disclosure is incomplete.

3) Risks, Side Effects & Aftercare

3.1 Potential side effects include temporary redness, swelling, soreness, tingling, bruising, transient discomfort, changes in skin sensation, and rare aggravation of symptoms. 3.2 You agree to follow aftercare instructions (e.g., hydration, activity modification, icing/heating guidance when applicable). 3.3 If you experience severe or unexpected reactions, you will seek immediate medical care and notify the Provider within 24 hours.

4) Informed Consent

4.1 You acknowledge receiving and understanding the Informed Consent and that your questions were answered. 4.2 You may withdraw consent at any time; however, fees for services already rendered are non-refundable (see §8).

5) Appointments, Scheduling & Cancellations

5.1 Appointments start and end at scheduled times; arriving late may reduce session length. 5.2 Cancellation Policy: Cancellations/reschedules require 48 hours’ notice. 5.3 Late Cancel/No-Show Fee: $full service fee or forfeiture of a session credit, applied at Provider’s discretion. 5.4 Provider may reschedule or cancel due to device maintenance, clinician availability, or safety concerns.

6) Treatment Plans & Session Cadence

6.1 The recommended number and frequency of sessions are individualized and not guaranteed to achieve specific outcomes. 6.2 Adjustments to the plan may be made based on response, tolerance, and safety.

7) Fees, Payment & Insurance

7.1 Session Fee: $175 per session; Assessment: $50. 7.2 Packages/Memberships: 5/10/25 Packs Available ranging from $750-$3,500 plus $35 mobile service in network free and $45mobile out of service network fee 7.3 Payment is due at time of service. We accept all major credit cards and debit cards. Cash. Venmo. 7.4 SoftWave Therapy may be out-of-network and may not be covered by insurance. Provider does not guarantee reimbursement. 7.5 You authorize Provider to charge any card on file for fees, late/cancel charges, and past due balances.

8) Refunds & Expirations

8.1 All services rendered are non-refundable. 8.2 Packages/Memberships are non-transferable and expire on the stated date. 8.3 Unused session credits after expiration are forfeited unless prohibited by law.

9) No Medical Guarantee; Limited Warranty

9.1 Provider does not warrant specific results, recovery timelines, or reduction of pain. 9.2 Any references to clinical literature are informational and not medical advice.

10) Client Conduct & Facility Policies

10.1 Respect staff, other clients, and facility rules. 10.2 Appropriate attire is required. Children must be supervised. 10.3 Provider may refuse service for unsafe, inappropriate, or disruptive behavior.

11) Health & Safety

11.1 Provider adheres to hygiene, device calibration, and safety protocols. 11.2 You will immediately report changes in health status relevant to treatment. 11.3 Provider may pause or discontinue treatment if safety concerns arise.

12) Adverse Events & Incident Reporting

12.1 Report adverse events to Provider within 24 hours and seek medical care. 12.2 Provider may document the event and, if required, notify appropriate authorities.

13) Privacy (HIPAA) & Data Use

13.1 Provider maintains confidentiality and protects your health information per HIPAA. 13.2 See our Notice of Privacy Practices for details on collection, use, disclosure, and your rights. 13.3 You consent to the secure storage of treatment notes, intake forms, and device data. 13.4 De-identified data may be used for quality improvement and aggregate analytics.

14) Telehealth & Electronic Communications

14.1 Telehealth consults may be offered and are subject to the same consent and privacy terms. 14.2 You consent to receive email/SMS reminders, confirmations, and updates. Standard message/data rates may apply.

15) Photo/Video/Testimonials (Optional)

15.1 With your separate written consent, Provider may capture treatment-related photos/videos for clinical documentation or marketing. 15.2 You may revoke marketing consent at any time (does not affect prior lawful use).

16) Intellectual Property

16.1 Provider’s manuals, protocols, and educational materials are protected. You agree not to copy, distribute, or reverse-engineer device protocols.

17) Assumption of Risk; Release & Indemnification

17.1 You assume all risks associated with elective SoftWave Therapy. 17.2 To the fullest extent permitted by law, you agree to release, defend, and indemnify Provider, its owners, clinicians, and staff from claims arising out of or related to your participation, except to the extent caused by Provider’s gross negligence or willful misconduct.

18) Limitation of Liability

18.1 Provider’s total liability for any claim arising from services is limited to the amount you paid for the affected session(s), to the extent permitted by law.

19) Governing Law; Dispute Resolution

19.1 These Terms are governed by the laws of the State of California without regard to conflicts of law. 19.2 Good-Faith Negotiation: Parties shall first attempt to resolve disputes informally within 30 days. 19.3 Arbitration: Unresolved disputes shall be submitted to binding arbitration in [San Diego, CA] under AAA rules. 19.4 Class Action Waiver: You agree not to participate in class or representative actions against Provider. 19.5 Injunctive Relief: Provider may seek injunctive relief for IP or confidentiality breaches.

20) Severability; No Waiver

20.1 If any provision is found unenforceable, the remaining provisions remain in effect. 20.2 Failure to enforce any provision does not constitute a waiver.

21) Changes to Terms

21.1 Provider may update these Terms at any time. The effective date will be posted. Continued use of services constitutes acceptance of updated Terms.

22) Entire Agreement

22.1 These Terms, together with the Informed Consent and Privacy Notice, constitute the entire agreement regarding SoftWave Therapy services.
